SA owned game farm under siege again by Zim war vets

A game farm in Beitbridge, which has for years been the target of repeated, illegal invasions by a group of war vets, has this week come under siege again.

The Denlynian farm, owned by South African citizen Ian Ferguson, has been battling with land invaders for over a decade. In 2010, a group of war vets and a gang of invaders led the slaughter of scores of animals on the property, before stripping the farm of most of its assets.

Ferguson, who bought the property almost 30 years ago, finally succeeded in securing a court order confirming that he and his family are the legal occupants of the farm. He also received a High Court order to secure the ejection of any land invaders and for the past 18 months there has been relative peace and stability on the property.

But this week, the same war vets, Rambelane Choene, Steven Mohadi (the younger brother of ZANU PF minister Kembo Mohadi), Julias Seziba, Juel Muleya, and many others returned. It’s understood the group have threatened the staff on the property as well as clients at the farm’s hunting lodge.

When local police were called, they ignored the illegal farm invaders and instead turned their attention to the visiting hunting clients, demanding to see their passports and permits. The police eventually left after ordering the hunters to leave.

The invasion of Denlynian this week comes as a ZANU PF government minister has said that no South African citizens have ever been affected by his party’s land grab campaign.

Deputy Minister Samuel Undenge told a visiting South African government official that there were “no cases of South Africans who have lost farms,” adding: “If you have any specific cases of farmers who lost their land during the reform programme bring them to our attention and we will be more than happy to respond and give the necessary information.”

The minister has since been heavily criticised for ‘blatantly lying’ about the situation in an attempt to attract investment from across the border. An estimated 500 South African farmers are said to have lost their land and livelihoods as a result of the land grab.

This latest invasion at the Ferguson owned property meanwhile further disputes Undenge’s comments. But there has been no word from the South African government about the incidents.

The South African Embassy in Harare have previously said that the farm is not protected under a Bilateral Investment Promotion and Protection Agreement (BIPPA), signed by South Africa and Zimbabwe in 2009 and ratified in 2010. According to this agreement any property which was gazetted for acquisition before 2009 is not protected under this BIPPA. Denlynian was gazetted in 2007.

As I understand it, many areas of Zim have been destroyed to such an extent that the squatters are moving from their own "plots" onto areas where there are still trees and grass left in order to be able to survive. Just like locusts.

One day soon there will be nothing left. Nothing at all. Wonder who they will start blaming then?

Invaders on Wednesday stormed a wildlife conservancy in Beitbridge, in a bid to take over a game farm, and in the process harassed foreign guests booked at the lodge.

This comes amid a wildlife conservation crisis in Zimbabwe, as over 100 elephants have died of cyanide poisoning at Hwange National Park.

Ian Ferguson, who together with his family owns the farm, said the “aggressive war veterans’” invasion of the farm was illegal as they did not have any rights whatsoever to the property.

“They were extremely aggressive and demanded that all our staff vacate their quarters and to get off the farm immediately and jerked some of the staff around and demanded the keys to the coldroom as they wanted to steal meat,” Ferguson said.

“They then went down to the Hunting Lodge where we have four overseas hunting clients and two professional hunters.

“They told the professional hunter to pack up and move the clients out which the professional hunter refused to do.”

Some of the war vets identified by Fergurson include Rambelane Choene, Steven Mohadi, the younger brother of Home Affairs minister Kembo Mohadi, Julias Seziba and Juel Muleya aka Majuta.

Ferguson said a bid to get relief from Beitbridge police was fruitless as they were friendlier to the war vets and started intimidating the professional hunter.

“We got hold of the police in Beitbridge who sent out three plain clothes Law and Order details who demanded that the clients show their passports and then harassed the professional hunter demanding permits etc and then made him take them down to where a problem animal elephant had been shot that National Parks had been informed about and all this at 1:30 in the morning,” Ferguson said.

“This all happened in the company of the war vets who they seemed very chummy with and then eventually left after telling the hunter that he must leave with the clients but did absolutely nothing with regards to the illegal invaders.

“The war vets said they were sent by the district administrator but on phoning him he denied it although we are quite sure that he was aware that it was going to happen and believe or so we were told by a police detail that the lands officer issued them all with new offer letters and told them they could go and occupy their so-called plots.”

Government last month announced that any farm invasion whether on black or white-owned farms was illegal.

Lands and Rural Resettlement minister Douglas Mombeshora said the issue of land redistribution needed to be guided by clear cut laws and policies as the ministry was working towards a Land Commission Bill.

Police in Beitbridge were this week facing accusations of ignoring a Court order to evict ZANU PF linked invaders from a South African owned game farm.

SW Radio Africa reported a fortnight ago that a horde of ZANU PF supporters led by war vets who included Steven Mohadi (the younger brother of ZANU PF minister Kembo Mohadi) had invaded the farm.

On Friday owner of Denlynian Farm, Ian Ferguson, told SW Radio Africa that the invaders have ‘virtually’ taken over and more invaders are still being transported into the farm.

Ahead of the takeover there were reports of invaders assaulting workers and families and harassing four Polish hunters who were at the game farm for trophy hunting. There were also reports of poaching and theft of meat, elephant skin, mattresses and hides, among other things.

But according to Ferguson the police are refusing to accompany the deputy sheriff of the High Court to evict the invaders. As a result, Ferguson said, the local sheriff was afraid to implement the court order without the police support.

Ferguson said the police are justifying their action on section 291 of the constitution which “apparently states that anyone occupying land at the inception of the new constitution must not be evicted.”

On top of that the police have also ordered the Fergusons that they must not return to the game farm because they were occupying it ‘illegally’. Ferguson described that as ‘ridiculous’ because he bought the farm 30 years ago.

Describing the whole drama as a ‘political’ incident, Ferguson said he had appealed to the sheriffs in Bulawayo and Harare and will know on Monday next week if either of the two will be able to intervene.

Denlynian Farm is not new to chaos. Three years ago war vets led another gang of invaders who pillaged the farm, slaughtering many animals in the process. Peace returned to the farm after Ferguson had secured a court order.

The latest invasion of the game farm follows recent claims by deputy minister Samuel Undenge that no South African citizen had lost their farm to land grab. At the time Undenge made the claims, he was described a ‘blatant liar’.

According to estimates about 500 South Africans have lost their properties to Zimbabwe’s violent land seizures.

Its racially politically motivated. If you shoot or threaten to shoot the police / Army or both arrive and arrest you for attempted murder. When you get back a week 2 weeks later your property is trashed.

The really bad about this is that our own country is fast sliding down a slippery slope to join Zimbabwe there at the bottom of the ladder too!

Virtually none of them were even born then.

Zim became independent in 1980 & the youngest of the so called freedom fighters would have been born around 15 years before the handover & yet the mobs are mostly in their 20s or so.......... nothing more than rent a mob...... To put it politely.

A Beitbridge game farmer, whose property was invaded by ZANU PF people last month, is seeking a new High Court after the police produced an old provisional order which they say bars him from evicting the invaders.The police have previously refused to effect another High Court order to evict the invaders from Denlynian Farm forcing the owner, Ian Ferguson, to appeal to the Sheriff in Harare.

The Southern Eye newspaper Thursday quoted Ferguson saying in a letter to a friend that ‘the deputy sheriff with a police escort will be ejecting the invaders’ on the same day following his appeal. But on Friday Ferguson told SW Radio Africa that the eviction did not go ahead, after the police produced a provisional order obtained by war vets who invaded his property three years ago.

Ferguson blamed the police for deliberately enforcing the provisional order wrongly, as it only bars him from evicting people from ‘their villages’ and not from his property. According to Ferguson the police refused to accept his explanation, forcing him to return to the court. Ferguson told SW Radio Africa that next week he will ask the High Court to set aside the order produced by the police.

A month ago SW Radio Africa reported that a horde of ZANU PF supporters led by war vets who included Steven Mohadi (the younger brother of ZANU PF Minister Kembo Mohadi) had invaded the farm.

Since then there have been reports of theft, poaching and harassment of staff and clients by the invaders. Only a fortnight ago Ferguson told SW Radio Africa that the invaders had ‘virtually’ taken over. All along the police have been refusing to accompany the High Court sheriff to evict the invaders.
