LHeym500April 10, 2019:
US District Judge Royce Lamberth, DC upheld permitting process adopted by Fish and Wildlife On March, 2018.
Lamberth is quoted the ESA does not require a lengthy, broad based transparent process before hunters can import.
The ESA requires only Fish and Wildlife to set protections for threatened species. How those protections are set is up to Fish and Wildlife. Fish and Wildlife issued enhancement findings as required by the ESA.
This decision would allow the case by case enhancement findings and permitting process brought by the Administration in March 2018.
This Federal District Judge is allowing the Agency to issue or deny permits under the ESA through Admin Order instead of rule making. Lawsuit before him by Friends of Animals and Zimbabwe Conservation Tas Force(anti hunting org not to be confused with Conservation Task Force) seeking to overturn the March 2018 policy has been dismissed.
