You already know this. When you "hire" a gunmaker to build you a gun, you already have a contract. A manifestation of mutual asset with either a promise to do something or a promise to refrain from doing something, and you already have a rememdy.
Oral contracts are enforceable, if nothing more than in quantum meruit.
So, why not write down what you have anyway, and make it more plain, SO THAT YOU DON'T HAVE TO LITIGATE AT $500.00 AN HOUR, OR SO THAT THE HOURS THAT YOU HAVE TO LITIGATE AT $500 AN HOUR ARE SHORTER IN NUMBER THAN THEY OTHERWISE WOULD BE.
