Voluntary and mandatory
Not exacctly gunsmithing, but pertains to business.. ATF sent notice about gun store employee background checks...The wording seems background checks are mandatory, but voluntary. Anyone run into this? Being an LLC, (as many gun shops are), mean that I should be subject to some other backgound check?

Duane, How did you receive this notice?

I haven't gotten a notice from the ATF in almost 15 years. I thought the requirement now is for you to check their website every day to see when they make changes? You do check the federal registry every day to make sure you are following all the newest regulations? Roll Eyes

At least that's what I was told the last time the worthless bureaucrats showed up to espouse their tyrannical bull shit.

rcraig, the ATF is very straightforward with their compliance definitions. It is mandatory for FFL holders, it is voluntary if you want to be an FFL holder.

The boss already had his background check!
Now, ATF sent out several emails earlier this year, OK, last year, to watch out for and how to detect straw purchasers. Check your email.

Good point, but it was patiently explained to me, by two ATF agents that the LLC is the owner...you may be right as "president" most likely not required...Maybe I should ask BATF???HAR!

Yes, saw the straw purchase email... I'll try and reporoduce the directive from BATF

My God...had no idea how m any emails to go thru, soooo...The "background " is the Bipartisan Safer Communities Act.."Firearms Handler" background checks are in process...whatever that means..designated to go through NCIS.

I'm just going to wait and be notified. I hate to make inquiry...the last time I pointed out that BATF made a minor typo in my address. had to reapply and pay another fee,,AND the typo was their mistake!

US Bureau of Alcohol, Tobacco, Firearms and Explosives




To: Federal Firearms Licensees (FFLs) in POC States

On June 25, 2022, the Bipartisan Safer Communities Act (BSCA) was signed into law. BSCA mandated FFLs to perform voluntary background checks on current and prospective employees. In anticipation of the future implementation of this new use of NICS, the FBI wants to allow ample time for you to prepare for this enhancement.

The employee background check Notice of Proposed Rulemaking (NPRM) has been posted to the Federal Register for a 30-day public comment period, under Regulation Identifier Number 1110-AA35. Please take this opportunity to provide any valuable feedback you may have. For your convenience, a link to the Federal Register NPRM is provided below. As outlined in the NPRM, this new use of NICS will be conducted using a new purpose identification number (Purpose ID) of 57 and written consent of the current or prospective employee will be required before an FFL may use NICS for this purpose. The Bureau of Alcohol, Tobacco, Firearms and Explosives will be releasing a form that FFLs may use to accomplish these requirements.

When the comment period has elapsed, the final regulatory rule must be completed and published before this use of NICS will be authorized.

For FFLs in POC states: You currently conduct business in a POC state where a state designated agency normally conducts background checks for firearms purposes. Currently, the use of NICS for employee checks through the state POC is only authorized in California, Connecticut, Illinois, Nevada, New York, and Virginia. Therefore, if not in these six states and you wish to submit these voluntary checks, you must enroll with FBI NICS for this purpose. The FBI’s NICS Section will contact you with instructions for enrollment prior to implementation of this use.

No mystery....we're going to have plenty more regulations and rules until about every gun shop owners/gunsmiths just say "To hell with it"

Back when Clinton was president they raised the fees. Put in New requirements and forced many FFL holders out of business.

Then complained that more people were dealing without a lic.

I am hoping with Trump in office ATF power is cut way back.

Of course they are trying to shut FFLs down

Ah! Email notifications. Those are funny. I've signed up for email notifications on 3 occasions. Had my web guy look into why I don't receive them. The @atf.gov address is flagged as malicious by google and are blocked before they even get to my inbox.

I thought that was appropriate.

Well currently, there is a bill in the House to abolish ATFE. Probably won't make it out of committee.

Would be better just to abolish GCA68.

If the law is still on the books some one will want to enforce it.

Abolishing the GCA would still have an over zelous one come and hastle ya' over the little things. Certainly, accuracy in record keeping is just as important as accuracy in the work performed. Been lucky here, I guess. Paperwork is easy, and its not hard to do in a timely manner (last thing I do at the end of the day, double check my paperwork) and inspectors have been decent people, and at times, helpful. Now, the next inspector that comes around will be young, a new hire, and ready to make a name for themselves!

No law, no FFL, no serial numbers, no record keeping and no other nastiness that GCA68 hoisted on us.

Be sure to remind anyone that you talk to, including the thugs from the ATF that 52%, PER THE ATF, 52% of all firearms used in crimes, come from local, state, and federal agencies.

Banning suppressors in the 1932 NFA act has not reduced poaching in any quantifiable way.

Banning machine guns in the 1932 NFA act has not reduced firearms crime in any quantifiable way. In fact, machines guns in crime are more prevalent today that any time in history.

Remember that the tyrants in Washington, whether they are red or blue, build a leviathan to control you, to make you guilty of endless process crimes.

Think of the millions of dollars in time and labor wasted on bureaucratic BS on a monthly basis.

The ATF still unabashedly requires you to have a manufacturing license to replace a part on a rifle. In 15 years, not one stooge has been able to tell me how to "manufacture" that rifle.

Most should be held criminally liable for their actions. The rest should be fined and then fired.

Then start on the Bureau of Information and Security who prevents me from exporting non-firearm gun parts because each individual part requires federal authorization of the individual purchaser. For an 1871 firing pin!

Deleting them is not enough.

Ah.... IF I have an audit..I think I'll keep
those thouhts to myself...HAR!

The way I see it, after 1968, FFL's were handed out like Haloween candy...Not very long..big problems with "shade tree dealers"

Gotta fix this! a moron can see the results of the fix. I think the problem was purosely created so there COULD be a "fix"
