Father disgusted at gun-shop charge

A gun-shop owner whose son shot a man carrying a machete is disgusted that he is to be charged.

On July 31, a man entered the Small Arms International Gun Shop in Penrose, Auckland, allegedly threatening to kill staff unless they gave him a gun.

A store director, Greg Carvell, 33, shot him in the stomach with a .45-calibre pistol.

The man, Ricky James Beckham, 29, survived and was later charged with assault with intent to rob. He will appear in court on November 24. Mr Carvell had been subpoenaed to appear as a witness.

Police said yesterday that they would charge Mr Carvell, a co-owner of the shop, with possession of a firearm without lawful, proper or sufficient purpose. He will appear in Auckland District Court on December 6.

Mr Carvell's father, shop co- owner Raymond Carvell, is furious. "How does the word disgusted sound to you?"

He said the charge was spurious given that his son was not also being charged with wounding with intent. "He shot the guy, didn't he? There is no question about that, it's not denied. He shot him in self-defence.

"They are saying he was unlawfully in possession of a firearm. This is a gun shop. He is entitled to be in possession of any weapon you can name."

Mr Carvell said the arms licensing inspector had given the shop a clean bill of health.

Police had decided not to charge his son but had been overruled by the Crown Law Office, he said. "My son was in fear of his life. I am angry. I have a right to be angry too; he was in defence of himself and his sales manager. He thought he was going to be killed."

He was angry police had announced the December 6 date but his son had not received his summons.

"We have cooperated with the police all the way through this investigation, because we have nothing to hide," Mr Carvell said.

He believed his son was not facing a more serious charge because it would go to a jury.

Mr Carvell said they had not wanted to whip up public frenzy because they believed police would not charge his son. It had taken 15 weeks to decide. "I have case law from right around the world sitting here and I will be interested to see who decided to prosecute."

A police national headquarters spokesman, Jon Neilson, said there would be no comment as the case was before the court.

The thing Greg Carvell did wrong was not kill Ricky James Beckham. A dead man cannot testify against you in court. Or generate sympathy.

And it seems that the police there are doing just what police here in my god-forsaken shithole of a community do; press as many charges a they can and let the lawyers fight it out. Then after many thousands of $$$ of legal fees and showing that the prosecutor won't be able to make his or her case in front of a jury, they drop the charges. And they call it justice. Harrumph.

I read this in a local paper. Fairly normal reaction from the law in this part of the world.

Personally I think the shooter should get a medal, who knows what trouble could have happened if he supplied the perp. with a gun.
The senseable thing would be any gunshop clerk licensed to carry/use a self-defence pistol.
Hell, just about every Jeweller I know has one.

The police here are also in a lot of trouble if they shoot someone. (They're always shooting mentally disturbed people weilding knives).

It's not uncommon to get off eventually, but the last security guard I read of was left sick sorry and about $200,000.00 in debt. (And that perp. didn't/couldn't testerfy or sue. He was "off the streets for good," so to speak.

its much better that the guy trying to rob the shop got shot, rather than them giving a gun to a crim who may have killed many people with it,

and besides, who the hell robs a gun shop with a knife!?

If he had handed over a pistol to the robber the police would probably be pressing to have the firearms dealers licence revoked instead.

They can't win.

Except they probably will after paying out hundreds of thousands of dollars in legal costs when the case is dropped or a judge throws it out.

Gidday Guys,

The poor bastard doesn't stand a chance.

Under New Zealand law if you have a dealers licence you are required to do all you can to stop the firearms under your control from falling into the hands of the criminal class.

If you use said firearms to prevent said criminal from chopping your staff and customers into fishbait so that he can get even more lethal weapons than his whopper copper chopper you will be charged with possesion of a firearm without proper purpose.

What has happened is that in our extraordinarily pc world the cops have tried to figure out how to get the poor bugger out of this catch 22 situation. They couldn't without copping a power of shit from the pc pro Helen brigade so the did the only thing they could.

They left it up to you and I (or in other words the 12 members of the jury) to say this is bullshit let this poor bastard go.

That way comrade Helens mob can't say our coppers have let him off.

Its a travesty and in the end the law abiding people will pay one way or the other.
