I had my 375 shipped from my gunsmith in PA to Florida. He shipped it to a local ffl. When I went to pick up the gun I was required to do another bacjground check. I own the gun, I bought it from ccn and I did my background check at same ffl. I drove the gun to PA but it was shipped back to me. Why do I have to do another background check on a gun I already own?

The gunsmith should have shipped it directly back to you. Once it goes to an FFL, he is required to go through the same documentation procedures as if your were buying the gun, as it had to be entered in his FFL log when he received it.

LionHunterYou are allowed to ship any firearm
you own directly to a licensed FFL (including licensed gunsmiths or manufacturers) and they can ship it directly back to you, without going through a local FFL (either way). Any FFL receiving a firearm is required to enter it into his bound book when received (from whom)and out of the book (to whom) when shipped/sold.

GeorgeSYou should not have to go through another check when a gunsmith returns the gun to you directly.
Since he erroneously shipped it to an FFL, you have to go through the check since the FFL put it in his A&D ledger.

pagosawingnutGeorge is correct. The repair guy should have shipped it directly back to you, since he shipped it to an FFL, you have to go through the BC because he had to enter it in his bound book.

Beretta682EGunsmith has a ffl and sells guns.
Ups will not allow me to ship a gun if there is not a ffl on the other side. I am not sure this is ups corp policy but I have had issues shipping guns in the us and they have asked for a ffl.
I just don't want the atf or any other government agency asking questions if I have multiple background checks on the same gun.

I'll save you the trouble of looking it up. The answer is yes, you do. See ATF FAQ.
- Do you still own the rifle? Yes.
- Did you own it the whole time it was in my possession? Yes.
- Does the ATF still require you to complete the 4473 again? Yes.
The question is not about whether or not you own it. The ATF wants to use that opportunity to ensure that you are actually qualified to own it. Were you a felon that brought the rifle in that's had it all this time illegally, etc... did you owe child support when you brought it in, etc...?
If your gunsmith is a licensed gunsmith or manufacturer, he can ship a repaired gun back to you... assuming he maintains a "repair log" separate from his A&D books.
