AMERICUS, Kan. -- An Emporia State University freshman
died during the weekend after being shot by someone in
a passing vehicle while he was hunting for geese.

Beau Arndt, 18, of Americus, and two friends had
placed several dozen goose decoys in a farm field
Saturday and were lying in the snow waiting for
incoming birds, according to the Lyon County Sheriff's
Department.

Arndt's companions told police that a pickup truck
stopped along a nearby road and fired a rifle shot
into the decoys, but hit Arndt instead and then left
the scene.

Shooting waterfowl with a rifle is illegal in Kansas,
as is shooting from inside a vehicle or onto someone's
property without permission.

Arndt was the first person killed in a hunting
accident in Kansas since 2005, state officials said.

The Emporia Gazette reported on Tuesday that witnesses
described a truck they'd seen as a late 1970s model
Ford pickup with a standard cab and a Shawnee County
license plate.

A witness told authorities there were three men
inside.

The newspaper reported that the cab and front end of
the truck were red and the bed was orange.

The rear of the bed had an old Ford logo on it, which
the newspaper reported as being three blocks - one
large, one medium and one small.

Authorities urged anyone with any information to call
the sheriff's office at 342-5545, the Lyon County
Crimestoppers organization at 342-2273 or 1-800-KS
CRIME.

How in the blue-eyed Hell can this be termed as a "Hunting Accident?." The guys in the truck should be taken out and skinned alive - they won't be - and this is not and never will be a "Hunting Accident." The perps, if and when caught, will turn out to be poor mis-treated when a child, deserving of another chance, sing in the church choir and teach Sunday school types just like so very many others we hear about. And New Jersy has outlawed the death penalty so look for others to follow suit - soon! May I be excused to go be sick? Mad

I'll check with the ex-wife who lives in Lyons county and see if she knows anything about this. Knowing her views on hunting, I'd put her as prime suspect if the vehicle had been a '96 Toyota Celica.

BREAKING: INVESTIGATORS FIND TRUCK, INTERVIEWING
PERSON POSSIBLY INVOLVED IN ARNDT SHOOTING

Lyon County sheriff’s deputies have found the pickup at the center of an investigation into the death of 18-year-old rural Americus resident Beau Arndt, and they have also found a person Sheriff Gary Eichorn said is possibly “the prime suspect†in Arndt’s death on Saturday.

Eichorn said the late 1970s-model Ford truck with red cab and orange bed was found in Topeka after deputies released composite drawings over the last two days.

Deputies were interviewing the person of interest as of noon Wednesday. With the interview in the early stages, Eichorn said there was nothing to contradict his earlier belief Arndt’s death was anything but a tragic accident.

Arndt was shot dead while hunting geese near Roads 310 and “D.†Eichorn said the pickup in question slowed down near Arndt’s hunting party, with at least one person shooting a rifle over decoys laid out by the hunters. One bullet mortally wounded Arndt.

Eichorn said deputies know the whereabouts of two others allegedly inside the truck at the time of the shooting. They had not been contacted as of noon Wednesday but Eichorn anticipates they will be interviewed soon.

Arndt’s funeral is at 11 am Thursday at the Harvest House of Flint Hills Christian Church. Burial will follow at Fruitland Cemetery near Americus.



BREAKING: ARREST BEING MADE IN ARNDT SHOOTING

An arrest has been made now in the case investigating the death of 18-year-old Beau Ardnt of Americus. Lyon County Sheriff Gary Eichorn told KVOE News interviews with a 57-year-old Topeka man was conducted in Topeka today, and the man was being brought back to Emporia. Arndt was shot to death Saturday morning about Eight o'clock while he and a friend were goose hunting about 8 miles northwest of Americus. A truck was being sought in connection with the investigation and now that truck has been found. Eichorn said that it would be up to Lyon County Attorney Mark Goodman as to what charges will be filed.



I figure manslaughter at least. Even if no one was injured, he was breaking at least 3 laws:
1. Road hunting
2. Rifle for fowl
3. Shooting at "birds" on ground. Illegal in KS; all birds must be in flight when shot. (Turkeys are classified as big game in KS)

Now there's an interesting law. What's the law on cripples then? I'm guessing there's an exception. Here in MA, you may not shoot at any birds under power (as in a boat), *unless* you're running down a cripple, and then you may shoot under power, but this applies to the coast only (seaward of the first man made obstruction, i.e., bridge). The law is really intended for seaducks, as they're so incredibly tough, and thus, can have lots of crips to chase down. If you couldn't do it under power, you'd lose most, if not all of them.

I never really thought about that; just took care of cripples on the water. I don't think any game warden would fine someone for doing that though.

IRC, some states, I believe Illinois for one, have the law stating something to the effect: "Illegal to shoot birds on the ground or water unless otherwise irretrievable." Makes sense to me as I have seen a lot of time wasted chasing a bird that should have been swatted and picked up.
