The Constitution is clear the President can suspend Habeas and only be suspended in time of rebellion or invasion with consent of Congress. The consent of Congress is mandatory.

Lincoln lost this issue bf the S. Ct, and he only unilaterally suspended Habeas along railroads when Congress was out of session.

Congress when it didn’t back into session passed legislation suspending Habeas as the Constitution mandates.

Every Executive following this has suspended Habeas after Congress passes legislation.

And no, we are not subject to an invasion.

A fourth prong is public safety.

The Constitution requires:
1) Rebellion or Invasion,
2) Consent of Congress,
3) Public Safety
And
4) Based on a 2008 S. Ct., not violate a
treaty that has been approved by the Senate. See Boumediene v. Bush, (2008).

Boumediene also found the Constitution grants a right to Habeas. I think it is the only right recognized in the body of the Constitution proper.

She and President Trump should be impeached and removed over all of this.

The sad part is, like some here, she knows the truth. She is just lying to manipulate people.
