International Student who was placed in custody for deportation orders released
Judge cites concerns over due process violations and 1st Amendment issues.

Federal judge in Vermont ordered immigration officials Friday to release Tufts University student Rümeysa Öztürk immediately from a Louisiana detention center where she’s been held for six weeks. He said she’s free to return to her home in Massachusetts.
Judge William Sessions made his order from the bench, saying he found serious claims “of both due process and first amendment violations” in her arrest in Somerville in March.

He also said the government’s only evidence presented over the past three weeks was an opinion piece Öztürk wrote criticizing Israel’s war in Gaza.
“There is no evidence here,” Sessions said, other than the op-ed.
Sessions declined to put a travel restriction on Öztürk, despite the government’s request. He said she’s engaged in an academic career which could require her to attend out-of-state programs.

The judge said his impression was that “this is a woman just totally committed to her academic career.” He said he found no evidence she was involved in violence or criminal activity and therefore presents no risk of flight.

Who would have thought the Executive cannot just declare you unfit to reside, grab you, and ship you off.

Who'd have thought a president would try to whisk someone away just because he didn't like her words?

That's the work of a tyrant, not a president.

If I was the judge, I'd sanction the government lawyers involved in defending the government's actions. A woman shouldn't be incarcerated for six weeks on a charge that's clearly barred by the Constitution.

Isn’t that a violation?

Isn’t violation of your visa grounds for revocation and expulsion?

Admittedly, the government apparently decided her one article in the student newspaper was a reason to deport her and was all they listed as far as reason to deport.

Graduate courses allow students to work as teaching assistant to offer tuition or board. It is often part of the offer, package.

International students on F-1 student visas can often work on campus as GTAs or TAs without needing additional work permits. They can also apply for work permits to teach off-campus through OPT (Optional Practical Training).

No, she is not in violation. The Federal government did not even try that one.

Not all countries allow it unless it is related to an internship which is specified in the visa for a limited duration.

I doubt she is any less safe than anyone else.

Work as a professional and there are always disgruntled folks out there.

I find it a bit interesting that in one of the articles it stated that she owns a home… Tufts must pay a heck of a lot better rates than any school I have been in if she can afford that. My recollection of student aid was it was capable of having a modest cost of living, but not being able to start investing.

If all she did was write a pro Palestinian article in the student newspaper, it seems a bit of a stretch to revoke her student visa over that… but if the piece was sufficiently inflammatory, then maybe…

Either the bureaucrats were lazy and did a piss poor job of documentation of the issues, or she should have been warned that you are a guest here and not here for political rabblerousing and if you want to stay, please avoid getting involved in politics here.

In my mind, the rights of a visitor are a bit different than the rights of a native with regards to political speech protections.

If she truly is an undesirable person, get her out. If she is not, leave her alone.

But the universities are kind of begging for this kind of behavior by not policing antisemitism (as technically incorrect as that phrase is) in the current situation.

For a supposedly smart person, her behavior demonstrates a lack of knowledge.
