If they take it. Nothing says they have to. And if they do take it, doubt the judgement itself gets changed. Damages reduced maybe. Again, the S. Ct., can grant cert or not.

It's sad that you hide be arcane legal terms. En banc does not, and doesn't in the case, mean unanimous.. but thats your intent.

Has the scotus EVER over turned every court under it and found a different decision? Of course

Has SCOTUS ever told a lower court " you got that wrong" of course they have
