JefffiveIt's actually pretty simple: If that pier is on privately-owned land and was built with and maintained by private funds they can do as they please.
If it occupies or crosses public land or land to which the public has a right to access, or if the construction or maintenance involves public funds, God only gets to vote with fire and brimstone.
