How ridiculous. It is a Repulican and his supporters who tried to undermine a legal election and stage a coupe.

The main from India by way of New Zealand does have a point. A violent action that Trump had the power and obligation to stop and refused. I do not take sanity instructions from the likes of you. I know who the Constitution requires to defend the Capital. I know who has the power over the SC Guard independent of any one else. I know the mob desired to stop and did delay certification. I know Trump wanted the certification stopped and directed VP Pence to not certify the election and return the delegates to the states. I know Trump tried to make the disbarred lawyer who came up w that scheme AG. I know Trump mused hanging VO Pence to be right. I know Trump refused to use his due power to stop the mob when the GOO 6 leader called for aid. I know Trump told us all that CO had to do the right thing when it came to decertification. Does not matter. We now it was not safe. We know the President has some authority over the DC Guard. I have posted primary source material proving that before. We know President Trump has the obligation and power under the Constitution to defend the Federal Government, the Capitol, the Congress, and the Constitution. We know Trump did not use his due authority and power to stop the mob. A mob he incited and allowed so he could keep power he was not entitled to keep.

Serious question… Where does it say protect the Capitol (all of DC was not under siege) as opposed to defend the country? I get Trump failed to do everything he could to protect the process and didn’t do his job, but you seem to be reading specifics where the constitution was more general. I don’t see where the president is specifically ordered to protect the Capitol, and as to one person, that’s kind of the purpose of a chain of command- multiple people are there to be fail safes. That what happened did while a condemnation of Trump is also a rather blanket condemnation of the security system in DC. Your moral indignation is a bit misplaced. Everyone in government should be a bit tarred with the brush you are using, and you seem to be taking an absolutist stance re DJT, but ignoring the lies, deception, anti-democratic behavior, and general low level chicanery of the side you are supporting. I get that Harris is lower key and less universal in the bad behavior, but it’s still more than I would support. Yes, I am not supporting Trump. But I also am not claiming someone else doesn’t do what he does when they do, just to a lesser degree.

He is the commander and chief who I have r primary documentation that he has full power over the DC Guard. He has the obligation under his oath. His oath is enshrined in the Constitution Before he enter on the Execution of his Office, he shall take the following Oath or Affirmation:—"I do solemnly swear (or affirm) that I will faithfully execute the Office of President of the United States, and will to the best of my Ability, preserve, protect and defend the Constitution of the United States." The President shall be Commander in Chief of the Army and Navy of the United States, and of the Militia of the several States, when called into the actual Service of the United States; he may require the Opinion, in writing, of the principal Officer in each of the executive Departments, upon any Subject relating to the Duties of their respective Offices, and he shall have Power to Grant Reprieves and Pardons for Offences against the United States, except in Cases of Impeachment. He had the power and obligation to stop the mob. The D.C National Guard was formed in 1802 by President Thomas Jefferson to defend the newly created District of Columbia. As such, the Commanding General of the D.C. National Guard is subordinate solely to the President of the United States. This authority to activate the D.C. National Guard has been delegated, by the President, to the Secretary of Defense and further delegated to the Secretary of the Army. The D.C. National Guard is the only National Guard unit, out of all of the 54 states and territories, which reports only to the President. The D.C. National Guard provides mission-ready personnel and units for active duty in the armed services in the time of war or national emergency. The D.C. National Guard also retains the mission as protector of the District of Columbia. Code § 49-409 for the below: As the U.S. federal government abolished the jurisdiction of the state of Maryland and states rights in Washington, D.C. to establish a federal district, there is no elected governor to command this guard unit. The District of Columbia National Guard is the only National Guard that reports only to the U.S. President. Supervision and control of District of Columbia National Guard was delegated by the President of the United States to the Secretary of Defense pursuant to Executive Order 10030, 26 January 1949 with authority given to the Secretary to designate officials of the National Military Establishment to administer affairs of the District of Columbia National Guard. The Secretary of the Army was directed to act for the Secretary of Defense in all matters pertaining to the ground component, and the Secretary of the Air Force was directed to act in all matters pertaining to the air component of the District of Columbia National Guard by Secretary of Defense Memorandum, 2 February 1949. The D.C. National Guard is the only United States military force empowered to function in a state or, in this case, a district status. Those functions range from limited actions during non-emergency situations to full scale law enforcement of martial law when local law enforcement officials can no longer maintain civil control. The National Guard may be called into federal service in response to a call by the President or Congress. When the D.C. National Guard is called to federal service, the U.S. President serves as Commander-in-Chief. The federal mission assigned to the U.S. National Guard is "To provide properly trained and equipped units for prompt mobilization for war, National emergency or as otherwise needed. It is not the Speaker’s fault, duty, nor power. It is blue the Sec of Defense’s fault, duty, nor power. It was Trump’s and Trump’s alone to defend the Capitol. My anger at Trump and for the GOP defending and mitigating Trump is correctly is placed. Trump committed the unpardonable and unforgivable sin. He tried to seize power against the will of the Sovereign people and the Constitution. He has made a segment of the body politic believe the election for presidency was obtained through malfeasance or “not pure” to use Dr. Eater’s words. Tge election was due and proper. The result was not obtained through bad faith, malfeasance, nor incorrect methods. Trump never got past judgment for failing to state a claim in Fed court. Trump was told by his campaign lawyers and SOJ that he lost clean. No sir, I have correctly placed my anger. Again, Al Gore lost on a contested election 5-4 at the Supreme Court. Trump owed us all the same behavior that Al Gore engaged after the courts ruled. Trump had the same obligation to defend our constitutional system that President Washington engaged in when mobs decided they did not have to follow due law.

Lane, I just can’t support that position. The Republican Party has scalawags and bad people in it. Any group of people does. The democrats have the same, and I do agree tend to have policies that are IMO problematic for the country, but there are individual democrats who are superior to individual republicans. Yes, the democrat party has a record of getting its members to follow party line much better than republicans have. Yes the democrat party apparatus does a much better job on doing its business long term than the republicans. Yes the democrats tend to be more professional politicians than the republicans. Unfortunately, when you try and defend a sleazeball like this guy (the trans porn watching officially “pro religion” fellow, you are condemning the good religious folks by allowing this POS to be considered as one of them, and while I am not going to say this guy did everything that is claimed, as a candidate for office you are supposed to be above reproach. The GOP didn’t do its job and find this crap first and either get proof it’s false or tell the guy, look, you may be a good fellow, but look at this crap- it WILL get brought up and you look like a lying hypocritical idiot if you can’t disprove it. I’ve met democrats who are good people and I’d support over this guy. The failure is not the democrat in this case, it’s the GOP. Sure, GOP policy may be superior, but you vote for a named individual in the US, and choosing the wrong person to be your standard bearer shows a lack of seriousness about your policy. The GOP can rightly point out the flaws of Harris, but they look silly because they tolerated the same flaws in spades in their candidate. The MAGA crowd showed a lack of concern for policy when they selected a candidate that contradicts their policy over folks who were much more likely to win and get at least most of the agenda delivered. I can’t support the idea that “any” R is superior to “any” D. As a Republican, I do believe “most” R are better, and the collective policy values are better, or I would be something else. I do recognize the hypocrisy of the national press telling the GOP that they need to select a moderate after the way they treated GOP moderates (Dole, Romney, McCain) when they had the chance, but I think any of the GOP candidates other than Trump would be leading a landslide come November, and Trump is just as likely to hand power to the sorry excuse of a not democratically selected candidate (as in there was no voter participation). Changing to the VP candidate because your presidential candidate was so flawed that everyone with contact with him knew it and allowed it to go or ward seems to me to be every bit as big a condemnation of the Democrat party as Trump is to the GOP, but because it’s Trump they can’t capitalize on it. Your R trumps all philosophy is what got us here. The GOP leadership refused to buck a guy who is unelectable (shades of HRC) because they thought that the party line would get him in. I can’t support Harris. I could support the Tim Walz I knew here. I can’t support DJT after all the knife marks he put in my political back. Unfortunately Vance seems to be doing his best to play to his boss’ fiddle which is making him look worse. What policy are we going to get with DJT? The I’m a big supporter of hunting and 2A rights guy he is on the stump, or the guy who said African hunting is a shit show and told his ATF to ban an item they had declared legal?

You seem to be missing the point. I’m giving you that Trump failed. Trump was supposed to ensure the security of the constitution, not the capitol. The Capitol is a symbol, and not specifically addressed. He did not do everything in his power to ensure that the laws of the United States with regards to a peaceful transition of power occurred. The chain of command is supposed to be if the top person is incapacitated or unavailable the next person down gets to make the call. President (I’m giving you that Trump failed) Vice President (pence refused to not do his job, but he didn’t step up and tell the guard to go when they couldn’t get anything urgently from Trump, and Trump did seem to sign some documents…) Then comes the speaker of the house. Pelosi did not tell the guard to deploy either. Down the road a bit there is the CG of the DC guard. He swears essentially the same oath as the President relating to supporting and defending the constitution of the United States. He refused to move when he saw the assault happening despite having orders to prepare to stop violence. It’s obvious since it didn’t happen that all of these folks failed. Yes, it was Trump’s job to deal with it. He didn’t. The rest didn’t either. It’s not Trump and Trump alone. I agree his failure makes him a bad choice for president. When will he throws funk again (giving the best possible interpretation to his inactivity)? The CO of the DC NG swears an oath to the constitution as does the VP and every congressman.

As you conveniently ignore, as pointed out in my response the Lowe rest solely with the President. The pier does not rest with the VP or the CO. The president is the only person who can direct the DC Guard. VP Pence performed his constitutional duty. He did so even when Trump directed him to violate that duty. He did so even as Trump mused hanging him was a good idea. Trump did not just fail. He had an affirmative duty and the constitutional power to stop it. He wanted the mob violence. He instigated the mob violence. He refused to use his sole and due power to stop it. Trump did so to use the mob to keep power he had no right to hold. Had President Obama had done what Trump did post election to allow the Dem candidate to achieve political power the right here would have called for 2nd Amendment remedies. President Obama ensured a peaceful transition of power to Trump. President Obama publicly rejected calls to use dubious legal theories concerning the Electoral College to deny Trump’s ascension to power. President Obama instructed VO Biden to have the election certified by Congress as the Constitution and federal law required. VP Biden strongly hammered down every merit less objection. President Obama loves America. Trump and those like him only love themselves and power. The duty, responsibility, requirement to transition the government peacefully and stop violence busted upon our Constitution in the form of an attack on the Capitol belonged to Trump. Trump permitted the violence bc he thought they violence was the pressure he needed to have VP Pence send the delegates back to the states for his false electors. There is no other point. It is not debatable. Had Trump succeeded, it would have been a coup. We would stop existing as we are and became a limited monarchy. Trump is a want to be tyrant. He attempt to seize power failed. I can only vote and present the truth when the lies and apologist speak. The sovereign people will de use if such a man and his party are permitted political power again. The DC Guard under the direct control of the president exists solely to protect the Capitol as I have sent out above. Congress meeting in joint session to certify a due ejection is the Constitution. The president is responsible to protect it. That is the president’s first, second, and third job. Protect the due operations of government prescribed by the Constitution. The Constitution is more than a piece of paper. The Constitution are those government actions that are prescribed, directed, and permitted by the Constitution and controlling federal precedent. There is no, “ Oh, Trump should have, but other people.” No, Trump must have. He did not for the sole reason he thought it was helping him keep power he had no right to. Thus, I will never vote for him, nor anyone who would be endorsed by him, nor anyone with his political posture. I would have voted to impeach him, or voted to convict him in the Senate on Articles of Impeachment due to Jan 6. He was not do convicted. The GOP renominated this disgrace and disgraced itself with it. Here we stand. May this election be the ruin for political debate and elections is the answer. If Trump wins this time, unless he is duly removed as prescribed by the Constitution, he will be my president. The truth is still the truth of his political sin against us all. Said other wise, even if politics does not deliver us from Trump, God is still God. You can look up the reference. The result is secondary to the process.

The law does not solely rest with the president. The law (USCMJ) pretty clearly delineates what can and should be done with illegitimate orders and directives. You make a very good point that trump failed. You miss the point that we have a system of laws and the president is not a king. Others have a responsibility to protect the constitution besides just the president. I haven’t seen court level proof that Trump instigated a revolt or insurrection. That is your opinion, and shared by many, but not all. There is proof that some members of the mob that stormed the capitol had the intent you lay out, but you haven’t produced that kind of proof re Trump, and listening to him, what happened was more likely an unanticipated consequence of his mental processes than an actual attempt at a armed revolt. You are attributing a motive that you have not proven exists. It is the duty of everyone in government and the military to see the rule of law presides in our government. It’s not the president’s alone, or you are conceding that we are not a republic, but rather a monarchy with some rather bizarre ways of appointing the king.

The Constitution is clear. The Federal Law, I have given you the citation, is clear. The president has the sole power over the DC Guard. The historical intent which I gave you in creating the DC Guard is clear. That being to allow the president to defend the Capitol. When the DC Guard was created, President Jefferson was concerned that DC was surrounded by states that might be hostile to the Federal Government. Thus, the DC Guard under direct control of the president has a direct tool to respond to threats to DC. The DC Guard is under direct control of the SC Guard. Trump said the hanging his VP was a good idea. Trump refused the call from help by his party’s leader in the House. Trump told the mob Pence had to do the right thing. Trump was prevented by the threat of mass resignations by from making Eastman who came up w the decertification scheme AG while Jan 6 was occurring. Trump knew through campaign lawyers and his AF that he lost the race clean. You can keep trying to mitigate and make excuses. I will rebut them. Trump wanted the mob to force the decertification scheme to happen. That is why he spoke to them as he did. That is why he gave VP Pence sn unconstitutional directive to not certify the results. That is why Trump told the assembly Pence had to do the right thing and Trump said, “I think he will.” That is why the mob upon breaching the police line focused on VP Pence. They were told on alt conservative news and by Trump that VP Pence had to prevent certification, send the election back to the states, and allow the false delegates to replace the delegates pursuant to a due election. We do not need proof beyond a responsible doubt. This is not a trial. This is an election. Impeachment is not a criminal trial and does not receive criminal trial due process. Impeachment is a political process. I have given that Supreme Court many times. Had Trump been permitted through his certification scheme been able to achieve his form of keeping power we would not exist anymore as a constitutional republic we have been. The President has the obligation to protect the Capitol, the Election, and the Constitution. All were attacked by a mob that was designed to keep Trump in power. Trump wanting that power refused to use the power and responsibility given to him by the Constitution and federal law to stop that violence. The discussion ends on that. Trump convinced a large segment of the body politic his loss was not clean. He then stoked that into violence that erupted as he tried to force his Bice President to not certify the election allowing for an unconstitutional preservation of Trump as president. No sir, the CO of the DC Guard cannot mobilize the DC Guard do authorization from the president. In my response, to your question originally that is clear. Fed law places the DC Guard under direct control of the president. You refuse to acknowledge that the head of the Executive Branch of the Federal Government with sole authority over the DC Guard by Federal law and his oath is required to defend the Federal Government in the Federal jurisdiction. The violence of Jan 6 rest with one man. That man is Trump. It was not an option for him to stop the violence. It was not an option for him to peacefully transition the government. It was a mandate that he stop the violence. It was a mandate that he transition the government peacefully.

That oath is prescribed by the US Constitution. The oath requires two things: that the oath-taker will faithfully execute the office of president, and that he will, to the best of his ability, preserve, protect and defend the Constitution of the United States. Doc Butler keeps focusing on the second thing. He argues that Trump didn't violate his oath because he promised to preserve, protect, and defend the constitution, not the capitol. So properly, this ought to be a two-part question. 1. Did Trump faithfully execute the office of president? and 2) Did he to the best of his ability, preserve, protect and defend the Constitution of the United States. 1. TRUMP DID NOT FAITHFULLY EXECUTE THE OFFICE OF PRESIDENT ON JANUARY 6. The Constitution establishes the president's office through articulated rights and duties in Article II. Among them is "he shall take Care that the Laws be faithfully executed." Art. II, Sec. 3. Trump violated this oath because he didn't uphold the Constitutional means for transferring power, in ways related by LHeym. 2. By intentionally violating the Constitutional means for transferring power, Trump violated the second part of his oath because he didn't to the best of his ability preserve, protect, and defend the Constitution of the United States. Instead he tried to tear apart provisions of the Constitution for his sole benefit. Fifty years from now, in our grandchildren's time they will wonder how half of a population fell so far into cultdom that they tried to elect the most destructive person in American history.

Let us just step back for a moment: DC is a purely federal jurisdiction created by Congress. The DC Guard was created by Congress. Congress gave sole discretion of the DC Gusrd to the setting president. These acts by Congress are done pursuant to the Constitution. The point in creating the DC Guard and giving the president direct control was because the Capitol was surrounded by states that could become hostile to the Fed government and March militias upon the Capitol. Militias that technically, pursuant to a Supreme Court case were ultimately under the power of the president, but were the militias of the states. These federal actions were taken under the authority of the Constitution. It is mind boggling and nonsensical to advance the president as Commander in Chief and Commander in Chief of the DC Guard by seperate fed law is not responsible to defend the Capitol, Congress performing the obligations of the Constitution, and the Constitution itself. Thus, the president is required to defend the Capitol. One to suggest otherwise is laughable.

The thread topics and posts on this forum are mind boggling. Here are mostly men in the sunset of life arguing and posting about politics. We’ve all heard this before. It’s from when we were 8 yrs old on the playground vehemently arguing our favorite baseball player is the best. And we are willing for to swear point fingers and fight over it. Meanwhile you’re all so old and fat you can’t hardly walk let alone go hunting….real hunting. Not riding in the truck all day. And so spend an inordinate amount of time online…like all kids…and porn viewers, all the while claiming moral and intellectual superiority. Nevermind our president is literally senile.
