Somebody noticed that the Founding Fathers encouraged citizens to own the most advanced military weapons of the day (rifles, as opposed to muskets).

The United States Army would not buy the early Gatling guns, no place for that kind of thing in the doctrines.
Officers bought then with private funds to equip their troops.
After a small contingent held off a much larger band of Indians with one, they reconsidered.

I ultimately come back to the fact in the late 1870s the US Army was giving Military Ammo away to civilian, US Citizen, Bison hunters.

In addition, after the Fed. Government was birthed, no Congress ever thought it had the stoke to ban any firearms. Not even in the 1930s, which is why Congress ultimately only taxed certain weapons.

Judge Benitez has issued/authored other pro 2nd amendment rulings.

They all have been shot down on appeal.

None have made it to the supreme court.

I believe that they are written for the supreme court.

If any one of them makes it to a supreme court hearing .

They will have the legal background to help get a favorable ruling.

Joke of a legal ruling that is going to get slapped down by 9th circuit court of appeals and won’t even be looked on by the supreme court.
